The Supremacy of the Yemeni Constitution: Concept, Types, and Manifestations

Abstract

Constitutional supremacy is considered the Constitution as the ultimate law in the state, not superior to another law, and it has two types of objective supremacy, which is based on the subject of constitutional rules and their content. It focused on the system of government in the state and its public authorities in terms of their formation, competencies and relationship to each other or to individuals and that is in all constitutions, whether written or flexible normal or strict, and it needs consolidation the principle of legality, and prevent the delegation of constitutional competencies except by a special provision in the Constitution.

It is formal supremacy that achieved when the modification of the Constitution requires special and more complex procedures and forms other than the procedures required to change ordinary laws, and it demands the stability of constitutional rules and not canceling them except by laws similar to them.
